Right of Withdrawal from the Contract

A consumer and a natural person concluding a contract directly related to their business activity, when the content of this contract indicates that it is not of a professional nature for that person, may withdraw from the contract within 14 days without giving a reason.

The period for withdrawal from the contract begins on the day the Customer or a third party indicated by them, other than the carrier, takes possession of the Goods.

Method of Withdrawal from the Contract

To exercise the right of withdrawal from the contract, the Customer should submit an unambiguous statement of withdrawal to the Seller.

The statement can be submitted:

• using the electronic withdrawal form,
• by email to kontakt@bluedvd.pl,
• in writing to the Seller’s address.

To meet the deadline, it is sufficient to send the statement before the 14-day period expires.

After submitting the electronic form, the Customer will receive a confirmation of receipt of the withdrawal statement to the provided email address.

Return of Goods

The Customer is obliged to return the Goods immediately, no later than 14 days from the day of informing the Seller about the withdrawal from the contract. To meet the deadline, it is sufficient to send back the Goods before its expiry.

The Customer bears the direct costs of returning the Goods, unless the Seller agrees to bear them.

The Customer is liable for any diminished value of the Goods resulting from using them in a manner exceeding what is necessary to ascertain the nature, characteristics, and functioning of the Goods.

Refund of Payments

In the event of an effective withdrawal from the contract, the Seller will refund all payments received from the Customer, including the cost of the cheapest ordinary delivery method offered in the Store, no later than 14 days from the day of receiving the statement of withdrawal from the contract.

The Seller may withhold the refund until the Goods are received or until the Customer provides proof of their return, whichever occurs first.

The refund will be made using the same payment method as used by the Customer, unless the Customer expressly agrees to a different refund method that does not incur additional costs for them.

Exclusions from the Right of Withdrawal

The right of withdrawal from the contract does not apply in cases specified in Article 38 of the Act of May 30, 2014, on consumer rights.

In particular, the right of withdrawal from the contract does not apply to a contract:

„w której przedmiotem świadczenia są nagrania dźwiękowe lub wizualne albo programy komputerowe dostarczane w zapieczętowanym opakowaniu, jeżeli opakowanie zostało otwarte po dostarczeniu”.

This means that the Customer loses the right to withdraw from the contract after opening the factory-sealed packaging of a Blu-ray, 4K Blu-ray, DVD, CD, or other medium containing an audio or visual recording.

Complaints

The Seller is obliged to deliver Goods to the Consumer and to an entrepreneur exercising consumer rights that are in conformity with the contract.

If the Goods are not in conformity with the contract, the Customer may demand their repair or replacement.

The Seller may replace the Good when the Customer demands repair, or repair it when the Customer demands replacement, if the method chosen by the Customer is impossible or would entail excessive costs.

Repair or replacement is carried out within a reasonable time, without undue inconvenience to the Customer and at the Seller’s expense.

The Customer may demand a price reduction or withdraw from the contract in cases specified in the consumer rights act, particularly when:

• The Seller refused to bring the Goods into conformity with the contract,
• The Seller failed to bring the Goods into conformity with the contract,
• the lack of conformity persists despite attempts at repair or replacement,
• the lack of conformity is significant enough to justify a price reduction or withdrawal from the contract,
• circumstances indicate that the Goods will not be brought into conformity with the contract within a reasonable time or without undue inconvenience.

The Customer cannot withdraw from the contract if the lack of conformity of the Goods with the contract is insignificant.

Method of Submitting a Complaint

A complaint can be submitted:

It is advisable to provide your first name and last name, Order number, description of the identified non-conformity of the Goods with the contract, and the Customer’s request in the complaint.

The Seller will respond to the complaint of a Consumer or an entrepreneur exercising consumer rights within 14 days from the date of its receipt.
