General Provisions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The online store operating at https:\/\/bluedvd.pl is operated by Web-site Pawe\u0142 Wi\u0119cek, ul. Skowronk\u00f3w 9\/58, 33-100 Tarn\u00f3w, Poland, NIP: 8732361374, REGON: 120063602, BDO number: 000648710, hereinafter referred to as the \u201cSeller\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms and Conditions set out the rules for using the Online Store, the provision of services by electronic means, the conclusion and performance of sales contracts, making payments, delivery of Goods, withdrawal from contracts, and the submission and handling of complaints.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms and Conditions are made available free of charge in a manner enabling them to be obtained, reproduced and stored.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. Call charges are in accordance with the Customer\u2019s telecommunications operator tariff.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3. Definitions<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Order Form<\/strong> \u2013 a form enabling the selection of Goods, the delivery method and payment method, and the placing of an Order.<\/li>\n\n\n\n<li><strong>Customer<\/strong> \u2013 a natural person having legal capacity, a legal person or an organisational unit granted legal capacity under applicable law, using the Online Store.<\/li>\n\n\n\n<li><strong>Consumer<\/strong> \u2013 a natural person entering into a legal transaction with the Seller which is not directly related to that person\u2019s business or professional activity.<\/li>\n\n\n\n<li><strong>Entrepreneur<\/strong> \u2013 a natural person, legal person or organisational unit conducting business or professional activity in its own name.<\/li>\n\n\n\n<li><strong>Entrepreneur with consumer rights<\/strong> \u2013 a natural person entering into a contract directly related to that person\u2019s business activity, where the content of the contract indicates that it is not of a professional nature for that person, resulting in particular from the subject matter of the business activity disclosed in CEIDG.<\/li>\n\n\n\n<li><strong>Customer Account<\/strong> \u2013 an individual Customer panel created after registration in the Online Store.<\/li>\n\n\n\n<li><strong>Cart<\/strong> \u2013 a function enabling the Customer to view selected Goods and change their quantity before placing an Order.<\/li>\n\n\n\n<li><strong>Online Store<\/strong> \u2013 the website available at https:\/\/bluedvd.pl.<\/li>\n\n\n\n<li><strong>Seller<\/strong> \u2013 the entity specified in section 1 of these Terms and Conditions.<\/li>\n\n\n\n<li><strong>Goods<\/strong> \u2013 movable items offered for sale in the Online Store.<\/li>\n\n\n\n<li><strong>Sales Contract<\/strong> \u2013 a distance sales contract concerning Goods concluded between the Customer and the Seller.<\/li>\n\n\n\n<li><strong>Order<\/strong> \u2013 a declaration made by the Customer using the Order Form, aimed directly at concluding a Sales Contract.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">4. Services Provided by Electronic Means<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller provides the following services by electronic means free of charge:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>enabling the Customer to browse the offer of the Online Store,<\/li>\n\n\n\n<li>enabling the use of the Cart and the Order Form,<\/li>\n\n\n\n<li>maintaining a Customer Account, if the Customer registers an account,<\/li>\n\n\n\n<li>enabling contact with the Seller using the available forms.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">To use the Online Store, the Customer must have a device with Internet access, an up-to-date web browser supporting cookies and JavaScript, and an active email address when placing an Order or creating a Customer Account.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer is required to use the Online Store in accordance with the law, generally accepted standards of conduct and these Terms and Conditions. It is prohibited to provide unlawful content or undertake activities that may disrupt the operation of the Online Store.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Complaints concerning services provided by electronic means may be submitted to kontakt@bluedvd.pl. The Seller will respond to the complaint within 14 days of receiving it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">5. Customer Account<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Browsing the product range and placing Orders does not require the creation of a Customer Account.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Creating and maintaining a Customer Account is voluntary and free of charge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer is required to provide true and up-to-date information and to protect login credentials against access by unauthorised persons.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer may close the Customer Account at any time by sending a request for its deletion to kontakt@bluedvd.pl. Deletion of the Account does not affect the obligation to retain Order documentation where such obligation arises from applicable law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">6. Placing Orders and Conclusion of the Sales Contract<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Orders may be placed 24 hours a day, 7 days a week using the Order Form.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In order to place an Order, the Customer selects the Goods, specifies their quantity, selects the delivery method and payment method, provides the information required to process the Order and accepts these Terms and Conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before placing an Order, the Customer is provided with information about the Goods, their price, delivery costs, available payment methods and the total amount payable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Order is placed by using a button clearly indicating that placing the Order entails an obligation to pay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the Order has been placed, the Seller sends the Customer confirmation of its receipt. The Sales Contract is concluded when a message confirming acceptance of the Order for processing is sent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Confirmation of the conclusion of the Sales Contract, including its essential terms and these Terms and Conditions, is sent to the Customer by email.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If advance payment is selected, the Customer should make payment within the period indicated when placing the Order or in the Order confirmation message. If payment is not made, the Seller may cancel the Order after the indicated period has expired without payment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller may refuse to process an Order if the Goods are unavailable, the Customer\u2019s details make it impossible to process the Order, or there is a justified suspicion of abuse. The Customer will be informed of this without undue delay and any payments received will be refunded.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">7. Prices and Payments<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The prices of Goods are expressed in Polish zloty and are gross prices, including applicable taxes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The binding price is the price of the Goods stated in the Order summary at the time the Order is placed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the Seller announces a reduction in the price of Goods, the reduced price is accompanied by the lowest price of those Goods applicable during the 30 days preceding the introduction of the price reduction and, in cases specified by applicable law, by the relevant information determined in accordance with such law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Available payment methods and any associated costs are presented when the Order is placed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">8. Delivery and Order Fulfilment<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Goods are delivered within the territory of the Republic of Poland and to other countries indicated as available when placing the Order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Available delivery methods, their costs and the estimated fulfilment time are presented on the Online Store website or when placing the Order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Order fulfilment period is calculated:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>in the case of advance payment \u2013 from the date on which the payment is credited or confirmation of its proper execution is received,<\/li>\n\n\n\n<li>in the case of payment on delivery \u2013 from the date on which the Order is accepted for processing.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If the Order includes Goods with different dispatch times, it may be dispatched after all the Goods have been collected, unless the Seller and the Customer agree otherwise.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">9. Right of Withdrawal from the Contract<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A Consumer and an Entrepreneur with consumer rights may withdraw from a distance Sales Contract without giving any reason within 14 days.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The period begins on the day on which the Customer or a third party designated by the Customer, other than the carrier, takes possession of the Goods. If the Order includes several Goods delivered separately, in batches or in parts, the period is calculated from the date on which the Customer takes possession of the last item, batch or part.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To exercise the right of withdrawal, the Customer should, before the expiry of the relevant period, send the Seller an unequivocal statement of withdrawal by post to the address specified in section 2 or by email to kontakt@bluedvd.pl.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer may use the withdrawal form provided at the end of these Terms and Conditions; however, use of the form is not mandatory.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer should return the Goods without undue delay and no later than 14 days from the date on which the Seller was informed of the withdrawal. To meet the deadline, it is sufficient to send the Goods back before the deadline expires.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer bears the direct costs of returning the Goods.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller refunds all payments received from the Customer, including the cost of the least expensive standard delivery method offered by the Online Store, no later than 14 days from receipt of the statement of withdrawal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The refund is made using the same payment method used by the Customer, unless the Customer agrees to another method that does not involve any costs for the Customer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller may withhold the refund until the Goods have been received or until the Customer provides proof that the Goods have been returned, whichever occurs first.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer is liable for any reduction in the value of the Goods resulting from using them in a manner exceeding what is necessary to establish their nature, characteristics and functioning.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The right of withdrawal from the Contract does not apply in the cases specified in Article 38 of the Consumer Rights Act, in particular with respect to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>sound recordings, visual recordings or computer software supplied in sealed packaging, if the packaging has been opened after delivery,<\/li>\n\n\n\n<li>Goods supplied in sealed packaging which cannot be returned after opening for reasons of health protection or hygiene, if the packaging has been opened after delivery,<\/li>\n\n\n\n<li>non-prefabricated Goods manufactured according to the Customer\u2019s specifications or intended to satisfy the Customer\u2019s individual needs,<\/li>\n\n\n\n<li>other cases specified by applicable law.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">10. Complaints and Lack of Conformity of the Goods with the Contract<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller is required to provide the Consumer and the Entrepreneur with consumer rights with Goods that conform to the Sales Contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller is liable for any lack of conformity of the Goods with the Contract existing at the time of delivery and disclosed within the period specified by applicable law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the Goods do not conform to the Contract, the Customer may request their repair or replacement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller may replace the Goods when the Customer requests repair, or repair the Goods when the Customer requests replacement, if the method chosen by the Customer is impossible or would involve excessive costs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Repair or replacement is carried out within a reasonable time, without excessive inconvenience to the Customer and at the Seller\u2019s expense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer may submit a statement requesting a price reduction or withdrawal from the Contract in the cases specified in the Consumer Rights Act, in particular where:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the Seller has refused to bring the Goods into conformity with the Contract,<\/li>\n\n\n\n<li>the Seller has failed to bring the Goods into conformity with the Contract,<\/li>\n\n\n\n<li>the lack of conformity continues despite an attempt to repair or replace the Goods,<\/li>\n\n\n\n<li>the lack of conformity is sufficiently serious to justify a price reduction or withdrawal from the Contract without a prior request for repair or replacement,<\/li>\n\n\n\n<li>the circumstances indicate that the Goods will not be brought into conformity with the Contract within a reasonable time or without excessive inconvenience.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer may not withdraw from the Contract if the lack of conformity of the Goods with the Contract is minor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A complaint may be submitted:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>in writing to the Seller\u2019s address,<\/li>\n\n\n\n<li>by email to kontakt@bluedvd.pl.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It is advisable to provide the Customer\u2019s details, Order number, a description of the lack of conformity and the Customer\u2019s request in the complaint. Providing this information is not a condition for the complaint to be considered if its subject matter can be determined in another way.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller will respond to a complaint submitted by a Consumer or an Entrepreneur with consumer rights within 14 days of receiving it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">With respect to Customers who are neither Consumers nor Entrepreneurs with consumer rights, the Seller\u2019s liability under the statutory warranty for defects is excluded to the extent permitted by law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">11. Alternative Methods of Dispute Resolution<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">After exhausting the complaint procedure, the Consumer may use out-of-court methods of handling complaints and pursuing claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In particular, the Consumer may:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>seek assistance from a municipal or district consumer ombudsman,<\/li>\n\n\n\n<li>seek assistance from a social organisation dealing with consumer protection,<\/li>\n\n\n\n<li>submit an application to the competent Provincial Inspector of Trade Inspection,<\/li>\n\n\n\n<li>submit an application to a permanent arbitration court operating at the Provincial Inspector of Trade Inspection,<\/li>\n\n\n\n<li>in the case of a cross-border dispute, seek assistance from the European Consumer Centre.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Information concerning out-of-court methods of dispute resolution is available on the websites of the Office of Competition and Consumer Protection and the competent consumer protection institutions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Use of an out-of-court dispute resolution method is voluntary and may require the consent of both parties.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">12. Personal Data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The controller of Customers\u2019 personal data is Web-site Pawe\u0142 Wi\u0119cek, ul. Skowronk\u00f3w 9\/58, 33-100 Tarn\u00f3w, Poland.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Personal data is processed for the purposes of managing the Customer Account, concluding and performing the Sales Contract, processing delivery, payments, returns and complaints, and fulfilling obligations arising from applicable law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Detailed information concerning the processing of personal data is provided in the Privacy Policy available on the Online Store website.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">13. Final Provisions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Contracts concluded through the Online Store are concluded in Polish. If other language versions are made available, the contract may also be concluded in the language selected by the Customer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Contracts are governed by Polish law, subject to mandatory consumer protection provisions applicable in the country of the Consumer\u2019s habitual residence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller may amend these Terms and Conditions in the event of changes in applicable law, payment or delivery methods, the functionality of the Online Store, the scope of services or the Seller\u2019s details.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Amendments to these Terms and Conditions do not affect acquired rights or the terms of Sales Contracts concluded before such amendments enter into force. Orders placed before an amendment to these Terms and Conditions are processed in accordance with the version applicable at the time the Order was placed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Registered Customers will be informed in advance of amendments concerning the Customer Account.
