The online store operating at https:\/\/bluedvd.pl is run by Web-site Pawe\u0142 Wi\u0119cek, ul. Skowronk\u00f3w 9\/58, 33-100 Tarn\u00f3w, NIP: 8732361374, REGON: 120063602, BDO number: 000648710, hereinafter referred to as the “Seller”.<\/p>\n\n
These Terms and Conditions define the rules for using the Online Store, providing services electronically, concluding and performing sales contracts, making payments, delivering Goods, withdrawing from contracts, and submitting and processing complaints.<\/p>\n\n
The Terms and Conditions are made available free of charge in a manner that allows for their acquisition, reproduction, and retention.<\/p>\n\n
Telephone contact is available from Monday to Friday, 8:00 AM \u2013 3:00 PM. The call charge is in accordance with the Customer’s operator tariff. <\/p>\n\n
The Seller provides free electronic services consisting of:<\/p>\n\n
To use the Online Store, a device with Internet access, an up-to-date web browser supporting cookies and JavaScript, and an active email address are required when placing an Order or creating a Customer Account.<\/p>\n\n
The Customer is obliged to use the Online Store in accordance with the law, good practices, and these Terms and Conditions. It is forbidden to provide unlawful content and to take actions that may disrupt the functioning of the Online Store. <\/p>\n\n
Complaints regarding services provided electronically can be submitted to kontakt@bluedvd.pl. The Seller will respond to the complaint within 14 days of its receipt. <\/p>\n\n
Browsing the assortment and placing Orders does not require creating a Customer Account.<\/p>\n\n
Creating and maintaining a Customer Account is voluntary and free of charge.<\/p>\n\n
The Customer is obliged to provide true and up-to-date data and to protect login data from unauthorized access.<\/p>\n\n
The Customer may at any time resign from the Customer Account by sending a request for its deletion to kontakt@bluedvd.pl. Deleting the Account does not affect the obligation to store Order documentation, if required by law. <\/p>\n\n
Orders can be placed 7 days a week, 24 hours a day, using the Order Form.<\/p>\n\n
To place an Order, the Customer selects the Good, specifies its quantity, chooses the delivery and payment method, provides the data required for Order fulfillment, and accepts the Terms and Conditions.<\/p>\n\n
Before placing an Order, the Customer receives information about the Good, its price, delivery costs, available payment methods, and the total amount to be paid.<\/p>\n\n
An Order is placed by using a button that clearly indicates that the Order entails an obligation to pay.<\/p>\n\n
After placing an Order, the Seller sends the Customer a confirmation of its receipt. The Sales Contract is concluded upon sending the message confirming the acceptance of the Order for fulfillment. <\/p>\n\n
Confirmation of the conclusion of the Sales Contract, including its essential terms and the Terms and Conditions, is sent to the Customer via email.<\/p>\n\n
In the case of prepayment, the Customer should make the payment within the period indicated during the Order placement or in the Order confirmation message. In the absence of payment, the Seller may cancel the Order after the unsuccessful expiry of the specified period. <\/p>\n\n
The Seller may refuse to fulfill an Order if the Good is unavailable, the Customer’s data prevents Order fulfillment, or there is a justified suspicion of abuse. The Customer will be informed immediately, and any payments received will be refunded. <\/p>\n\n
Prices of Goods are expressed in Polish zlotys and are gross prices, including applicable taxes.<\/p>\n\n
The binding price is the price of the Good indicated in the Order summary at the time of its placement.<\/p>\n\n
If the Seller informs about a price reduction for a Good, next to the reduced price, it also provides the lowest price of that Good applicable within 30 days before the reduction was introduced, and in cases specified by regulations \u2013 appropriate information determined in accordance with those regulations.<\/p>\n\n
Available payment methods and any associated costs are presented during the Order placement.<\/p>\n\n
Goods are delivered within the territory of the Republic of Poland and to other countries indicated as available during Order placement.<\/p>\n\n
Available delivery methods, their costs, and estimated fulfillment time are presented on the Online Store’s website or during Order placement.<\/p>\n\n
The Order fulfillment period is calculated:<\/p>\n\n
If an Order includes Goods with different shipping times, it may be shipped after all Goods have been collected, unless the Seller and the Customer agree otherwise.<\/p>\n\n
The Consumer and the Entrepreneur with Consumer Rights may withdraw from a Sales Contract concluded remotely without stating a reason within 14 days.<\/p>\n\n
The period begins from the day the Customer or a third party indicated by them, other than the carrier, takes possession of the Good. If the Order includes many Goods delivered separately, in batches or in parts, the period is counted from taking possession of the last Good, batch, or part. <\/p>\n\n
To exercise the right of withdrawal, the Customer should send an unambiguous statement to the Seller by post to the address indicated in point 2 or by email to kontakt@bluedvd.pl before the deadline expires.<\/p>\n\n
The Customer may use the withdrawal form provided at the end of the Terms and Conditions, but this is not obligatory.<\/p>\n\n
The Customer should return the Good immediately, no later than 14 days from the day of informing the Seller about the withdrawal. To meet the deadline, it is sufficient to send back the Good before its expiry. <\/p>\n\n
The Customer bears the direct costs of returning the Good.<\/p>\n\n
The Seller refunds to the Customer all received payments, including the cost of the cheapest ordinary delivery method offered in the Online Store, no later than 14 days from receiving the statement of withdrawal.<\/p>\n\n
The refund is made using the same payment method as used by the Customer, unless the Customer agrees to a different method that does not incur costs for them.<\/p>\n\n
The Seller may withhold the refund until receiving the Good or until the Customer provides proof of its return, whichever occurs first.<\/p>\n\n
The Customer is liable for any decrease in the value of the Good resulting from its use in a manner exceeding what is necessary to ascertain its nature, characteristics, and functioning.<\/p>\n\n
The right of withdrawal from the Contract does not apply in cases specified in Article 38 of the Consumer Rights Act, in particular with regard to: <\/p>\n\n
The Seller is obliged to deliver to the Consumer and the Entrepreneur with Consumer Rights Goods that conform to the Sales Contract.<\/p>\n\n
The Seller is liable for any lack of conformity of the Good with the Contract existing at the time of its delivery and revealed within the period specified by applicable regulations.<\/p>\n\n
If the Good is non-conforming with the Contract, the Customer may demand its repair or replacement.<\/p>\n\n
The Seller may replace the Good when the Customer demands repair, or repair it when the Customer demands replacement, if the method chosen by the Customer is impossible or would entail excessive costs.<\/p>\n\n
Repair or replacement is carried out within a reasonable time, without undue inconvenience to the Customer and at the Seller’s expense.<\/p>\n\n
The Customer may submit a statement of price reduction or withdrawal from the Contract in cases specified in the Consumer Rights Act, in particular when:<\/p>\n\n
The Customer cannot withdraw from the Contract if the lack of conformity of the Good with the Contract is insignificant.<\/p>\n\n
A complaint can be submitted:<\/p>\n\n
It is advisable to provide the Customer’s data, Order number, description of the non-conformity, and the Customer’s request in the submission. Providing this information is not a condition for processing the complaint if its subject can be determined otherwise. <\/p>\n\n
The Seller will respond to the complaint of a Consumer or an Entrepreneur with Consumer Rights within 14 days of its receipt.<\/p>\n\n
For Customers who are neither Consumers nor Entrepreneurs with Consumer Rights, the Seller’s liability under warranty is excluded to the extent permitted by law.<\/p>\n\n
After exhausting the complaint procedure, the Consumer may use out-of-court methods for resolving complaints and pursuing claims.<\/p>\n\n

Information regarding out-of-court dispute resolution methods is available on the websites of the Office of Competition and Consumer Protection and relevant consumer protection institutions.<\/p>\n\n
Using an out-of-court dispute resolution method is voluntary and may require the consent of both parties.<\/p>\n\n

Personal data is processed for the purpose of operating the Customer Account, concluding and performing the Sales Contract, fulfilling delivery, payments, returns, and complaints, and performing obligations arising from legal provisions.<\/p>\n\n
Detailed information regarding the processing of personal data can be found in the Privacy Policy available on the Online Store’s website.<\/p>\n\n
Agreements concluded through the Online Store are entered into in Polish. Should other language versions be made available, the agreement may also be concluded in the language chosen by the Customer. <\/p>\n\n
Polish law applies to Contracts, subject to mandatory provisions protecting the consumer applicable to their country of habitual residence.<\/p>\n\n
The Seller may amend the Terms and Conditions in the event of changes in legal provisions, payment or delivery methods, Online Store functionality, scope of services, or Seller’s data.<\/p>\n\n
Changes to the Terms and Conditions do not affect acquired rights or the terms of Sales Contracts concluded before their entry into force. Orders placed before the amendment of the Terms and Conditions are fulfilled in accordance with the version applicable at the time of their placement. <\/p>\n\n
Registered Customers will be informed of changes regarding the Customer Account with appropriate advance notice. A Customer who does not accept the changes may resign from the Account before they come into force. <\/p>\n\n
In matters not regulated by these Terms and Conditions, applicable legal provisions shall apply, in particular the Civil Code, the Consumer Rights Act, and provisions regarding the provision of electronic services.<\/p>\n\n
